Momentum is building around our lawsuit to validate the Equal Rights Amendment, and the hearing is now just one week away.
A recent Boston Globe column by Jeff Jacoby highlighted our case, EQUAL MEANS EQUAL v. Donald Trump.
EME Attorney Wendy Murphy responded:
“Conservative Globe columnist Jeff Jacoby this week shined a light on our lawsuit to validate the ERA. He says our argument is weak because it rests on morality rather than law. In fact, our argument rests on a powerful legal argument about the United States Constitution and the careful balance of powers our founders established between the federal and state governments; a balance that was designed to ensure that the voices of the American People will never be drowned out by the monied interests that control Congress. This careful balance is at stake in our case, not only for Women but for all people who see the words EQUAL JUSTICE UNDER LAW carved in stone outside the Supreme Court in Washington DC, and feel strongly that those words should mean what they say.”
Attention around the ERA is growing. President Biden has stated that the ERA has satisfied the constitutional requirements for ratification, and the American Bar Association has also recognized the amendment’s constitutional validity. In fact, the ABA is holding a session examining the ERA the day after our hearing.
Judges notice when the public, media, and legal institutions are paying attention. We need to keep that momentum building.

We have also published a new Substack article explaining why this case matters now and what is at stake in the constitutional balance of power between Congress and the states.

The Constitution gave the states the power to ratify amendments. The states exercised that power. This case asks the court to recognize that constitutional reality.
Thank you for helping bring attention to this historic moment.
