On January 7th of 2020 EQUAL MEANS EQUAL filed a complaint in Massachusetts District Court against David Ferriero, in his role as U.S. Archivist, for failing to publish the Equal Rights Amendment as was required by Article V of the U.S. Constitution upon the ratification of three-fourths of the states.
On April 14, 2020, the Archivist filed a Motion to Dismiss, which was granted on August 6, 2020 on the grounds that Plaintiffs lack Article III standing. EQUAL MEANS EQUAL appealed and filed a petition for certiorari with the U.S.
Supreme Court, which was denied on October 13, 2020. The First Circuit Court ruled against Plaintiffs on June 29, 2021, on the grounds that they lack Article III standing.
